Terms of Service

Terms and conditions governing our moving and storage services

Acceptance of Terms

These Terms of Service ("Terms") govern your use of services provided by State-Wide Moving & Storage Co. ("Company," "we," "us," or "our"), including moving, storage, and related services. By engaging our services, you ("Customer," "you," or "your") agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. If you do not agree to these Terms, do not use our services. These Terms include important limitations on our liability and your rights, as well as dispute resolution provisions.

Our Services

State-Wide Moving & Storage provides the following services:

  • Local and long-distance residential moving
  • Commercial and office relocations
  • Piano and specialty item moving
  • Packing and unpacking services
  • Climate-controlled storage solutions
  • Moving supplies and materials
  • Insurance and valuation coverage

All services are subject to availability and may vary based on location, timing, and specific customer requirements.

Estimates and Pricing

Written Estimates

All estimates are provided in writing and are valid for 30 days unless otherwise specified. Estimates are based on information provided by the customer and are subject to change if actual conditions differ from those described.

Binding vs. Non-Binding Estimates

  • Binding Estimates: Final cost will not exceed the estimated amount, provided services and inventory remain as specified
  • Non-Binding Estimates: Final cost may vary based on actual services provided and inventory moved

Payment Terms

Payment terms will be specified in your moving contract and may include:

  • Deposit required to secure services
  • Payment due upon completion of services
  • Accepted payment methods: cash, check, credit card
  • Additional charges for services not included in original estimate

Customer Responsibilities

As the customer, you are responsible for:

  • Providing accurate and complete information about your move
  • Preparing items for moving according to our guidelines
  • Being present or having an authorized representative during pickup and delivery
  • Ensuring access to both origin and destination locations
  • Removing personal or valuable items not suitable for transport
  • Providing adequate parking and access for our moving vehicles
  • Notifying us of any hazardous materials or special requirements
  • Making payment according to agreed terms

Prohibited Items

We cannot transport the following items:

  • Hazardous materials (paint, gasoline, propane, chemicals)
  • Perishable food items
  • Plants (for long-distance moves)
  • Pets and live animals
  • Personal documents, jewelry, and irreplaceable items
  • Ammunition, firearms, and explosives
  • Illegal substances or stolen goods

Customer assumes full responsibility for prohibited items transported without our knowledge.

Liability and Insurance

Basic Transportation Coverage

We provide basic transportation coverage at no additional charge, which covers loss or damage at $0.60 per pound per item. This limited coverage may not fully compensate for the replacement value of damaged items.

Full Value Protection

We offer Full Value Protection for an additional charge, which provides coverage for the full replacement value of lost or damaged items, subject to terms and conditions outlined in your moving contract.

Claims Process

  • Claims must be reported within 9 months of delivery
  • Written claims must be filed within 120 days of delivery
  • We will acknowledge claims within 30 days
  • Final disposition will be made within 120 days of claim filing

Cancellation and Rescheduling

  • Cancellations must be made at least 48 hours before scheduled move date
  • Cancellations within 48 hours may result in cancellation fees
  • Rescheduling requests will be accommodated based on availability
  • Weather-related delays or cancellations will not result in additional charges
  • Deposits may be non-refundable for late cancellations

Storage Services

If you use our storage services:

  • Monthly storage fees begin on the date items are placed in storage
  • Payment is due in advance for each storage period
  • Items must be retrieved within agreed timeframe
  • We reserve the right to dispose of items for non-payment after proper notice
  • Storage facilities are climate-controlled and secure
  • Access to stored items requires advance notice

Limitation of Liability

IMPORTANT LIABILITY LIMITATIONS:

Our liability is limited by federal regulations governing household goods carriers. We are not liable for indirect, consequential, or special damages.

  • Maximum liability limited to declared value or actual loss, whichever is less
  • No liability for delays beyond our reasonable control
  • No liability for pre-existing damage to items
  • Customer must inspect items upon delivery and note any damage

Force Majeure

We are not liable for delays or inability to perform services due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters and severe weather
  • Government actions and regulations
  • Labor disputes and strikes
  • Equipment failures and accidents
  • Public health emergencies

Dispute Resolution

In the event of disputes regarding our services:

  1. Customer should first contact our customer service department
  2. Unresolved disputes may be submitted to binding arbitration
  3. Arbitration will be conducted according to rules of the American Arbitration Association
  4. Federal and state laws governing household goods carriers will apply

Governing Law

These Terms are governed by the laws of the State of New Jersey and applicable federal regulations governing household goods carriers. Any legal action must be brought in the appropriate courts of New Jersey.

Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated to customers with existing contracts. Continued use of our services after changes constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
